Terms of Service

1. Agreement to Terms

By accessing and using Emani, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Emani provides SafeCheckout-protected payment services for social commerce. We act as a neutral third party that holds the buyer's money until they confirm receipt of goods or services, or until the auto-release period expires.

3. SafeCheckout Process & Protection

• Holding the Money: When a buyer makes a payment, Emani holds it in a SafeCheckout account.
• Confirmation: Buyers are encouraged to confirm receipt of the item to release the money to the vendor.
• Auto-Release: The money is automatically released to the vendor after a specified period (24-72 hours depending on order value) if no dispute is raised.
• Fees: We charge a service fee (currently 2.5% of the order value) for SafeCheckout protection, payment processing, and dispute mediation. This fee is non-refundable in all circumstances, including cancellations and refunds.

4. Dispute Resolution

In the event of a disagreement, either party can open a dispute. Emani uses a three-stage resolution process:

1. AI Triage: Our AI analyzes the evidence provided by both parties.
2. Vendor Response: The vendor has 24 hours to respond to the claim.
3. Human Mediation: If no agreement is reached, an Emani mediator will make a final, binding decision within 48-72 hours.

5. Payouts

Vendors can request payouts once the money is released from SafeCheckout. Payouts are made to the bank account details provided by the vendor. Payout processing times may vary based on bank schedules.

6. Prohibited Activities

You may not use Emani for any illegal transactions or activities that violate Nigerian law or international financial regulations. We reserve the right to suspend accounts suspected of fraudulent activity.

7. Limitation of Liability

Emani is a facilitator of transactions and is not responsible for the quality, safety, or legality of the items sold by vendors.
